I sold a 12' fishing boat with a 1975 7.5 horse Mercury. Long story short, The original motor seized over last winter, I took it all apart, but quickly realized I am not mechanic and had no idea what the hell I was doing. So I went on the wonderful world of craigslist, and found a guy near by with the same motor. So i snagged it up for $100...Fished with my roomate almost everyday for about 2 weeks, and we soon realised we wanted something a little bigger and faster. So I put it up forsale on CL. Sold it for $500, included boat, motor, trailer, the other torn down motor, life jackets, anchor, net...a steal( 4 years ago I got the Boat and trailer alone for $400.
3 weeks later the guy shows up @ my door, and says it is not running right, he says its slow, and dies quite often. Now...when he bought the boat, I told him, that it is a small boat, with a small engine, its not going to be fast with him and his 2 kids (7/10 yrs old), gear onboard. and I also told him that we had to relapce the Pullstart recoil.
Now...he apparently took it to a local boat dealer, and they wouldnt even look at it, but gave him the number of a place an hour away. He took it down there, and they gutted the thing. said that anyone that had this motor "knew it was screwed". I guess there was a part that was fixed wrong...so he racked up $200 in repairs there...
So he shows up asking if I want it back. i said no, we were in the market for a bigger boat, that is why I sold mine. Then he claims that i knew it was a bad motor, and wanted me to pay for the repairs, i obviously declined, now he is threatening me with court. Does he have a case? Should I worry? Like I said I am not a mechanic. i sold it knowing that we fished everyday for 2 weeks with it, and just wanted a bigger boat.|||He has zero case.
All private party used vehicle sales (including boats) are by law "As-Is, Where-Is" unless a specific warranty is given.
Richard|||Do not worry he has no case. You did not know about the problem and did not give him any warranty. Buyer beware anytime buying used.
